1. Introduction

Welcome to Olive for Education. These Terms of Service govern your use of the Olive for Education Store and the services, features, content, and applications offered by Olive for Education (collectively, the “Services”). 

By accessing or using the Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or our Privacy Policy, please do not access or use the Services. 

2. Eligibility

You must be at least 13 years old to use the Services. By accessing or using the Services, you represent and warrant that you are at least 13 years old and have not been previously suspended or removed from the Services.

By submitting, uploading, publishing, or otherwise making available any User Content, you grant Olive for Education a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit in any manner such User Content in all formats and distribution channels now known or hereafter devised (including in connection with the Services and Olive for Education’s business and on third-party sites and services), without further notice to or consent from you, and without the requirement of payment to you or any other person or entity. 

5. Prohibited Conduct

You agree not to engage in any of the following prohibited activities: 

– Violating any applicable law or regulation; 

– Using the Services for any unlawful purpose or in any manner that could damage, disable, overburden, or impair the Services; 

– Attempting to gain unauthorized access to the Services or another user’s account; 

– Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity; 

– Transmitting any material that is abusive, harassing, tortious, defamatory, vulgar, pornographic, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable; 

– Transmitting any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of solicitation; 

– Transmitting any material that contains adware, malware, spyware, software viruses, or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment; 

– Stalking, harassing, or harming another individual; 

– Interfering with or disrupting the Services or servers or networks connected to the Services, or disobeying any requirements, procedures, policies, or regulations of networks connected to the Services. 

6. Disclaimers

The Services are provided “AS-IS” and “AS AVAILABLE” and we expressly disclaim any warranties and conditions of any kind, whether express or implied, including the warranties or conditions of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, or non-infringement. We make no warranty that the Services: (a) will meet your requirements; (b) will be available on an uninterrupted, timely, secure, or error-free basis; or (c) will be accurate, reliable, free of viruses or other harmful code, complete, legal, or safe. 

7. Limitation of Liability

In no event shall Olive for Education, its affiliates, agents, directors, employees, suppliers, or licensors be liable to you for any claims, proceedings, liabilities, obligations, damages, losses or costs in an amount exceeding the amount you paid to Olive for Education hereunder or $100.00, whichever is greater. 

8. Indemnification

You agree to indemnify and hold Olive for Education, its affiliates, agents, directors, employees, suppliers, and licensors harmless from any losses, costs, liabilities and expenses (including reasonable attorneys’ fees) relating to or arising out of: (a) your use of or inability to use the Services; (b) your violation of these Terms of Service; (c) your violation of any rights of another party; or (d) your violation of any applicable laws, rules or regulations.
